鑑於單以普通刑法規範食品安全問題有一定侷限，因而有《食品安全衛生管理法》（原名為《食品衛生管理法》）之立法。收錄文獻首先概括介紹食品安全之刑事規範以及相關管制之手段與相關人等之歸責。再藉由評析歷年著名爭議案例釐清何種行為屬於「摻偽假冒」而該當刑法或食品安全衛生管理法中食品安全之相關法規，而須負刑事責任，進一步認識現行實務處理食品安全案件之標準。
